This work of professional sufficiency describes the legal facts, where the Constitutional Court intervenes as the last instance through the amparo route. In this regard, the development of the present emphasizes determining the responsibility of the decision to renew or not the registration of a student the following year at his or her educational center, demonstrating an alleged violation of Law No. 28044, General Education Law. The intervening parties are the mother of the minor with the initials P.N.F.F. (plaintiff) and a private educational center (defendant). Well, what has arisen throughout the file is described, where the foundations of the educational institution, with respect to non-renewal, is due to the fact that the minor with initials P.N.F.F. He presented attitudes that were not in accordance with his internal regulations and affected the rights of his colleagues. On the other hand, we have the mother of the minor, who maintains her position by considering that the institution has violated the basic rights of her minor son: access to the right to education. Summarizing, to resolve the case, what was described by the teaching staff of the educational institution was considered, as well as the incident log. Finally, they decided to declare the claim for protection unfounded, given that there were objective and reliable reasons that supported the decision made by the educational institution regarding non-renewal. The present work on professional sufficiency is based on national and international antecedents, as well as a theoretical framework that bases the applied regulations. The legal matter of the case is access to the right to education, the research topic analyzed is the impact on access to the right to education in the face of internal school regulations, and, finally, it is concluded that the research carried out makes a contribution to legal research, since it describes the impact that regulations currently have and how they affect the fundamental rights of minors and the free development of their personality, in accordance with the precepts of the Political Constitution of Peru.
