This work exposes and analyzes the sentence issued in File N° 01505-2018-PA/TC by the Constitutional Court (TC below), which originated from a constitutional grievance appeal filed by Mrs. M.A.Z.C., against the First Chamber Civil of Justice of Callao because the plaintiff sought to disapply Directorial Resolution 927-2015 MGP/DGP dated 09/17/2015. Said Resolution separates her and dismisses her from the CITEN Higher Naval Technological Institute, due to psychophysical inability of psychosomatic origin. Likewise, he requested the inapplicability of the Resolution of the General Command of the Navy 0612-2015-CGMG dated 11/11/2015, which declares his appeal unfounded. To carry out the analysis of this case, various sources were consulted; such as legal norms, TC rulings and scientific articles. Finally, it was considered that the decision adopted by the majority of the TC was necessary so that the case could be resolved in such a way, that is, protecting the claim, in terms of defending and addressing the following fundamental rights, such as the right to health, right to free development and well-being, to life and physical integrity. Likewise, leading to reincorporation into the IESTPN-CITEN.
