Through this document, we will proceed to present and analyze the Judgment of the Constitutional Court issued in the context of File 01272-2017-PA/TC. This judgment addresses a constitutional grievance appeal for protection filed by Mrs. Duberlis Nina Cáceres Ramos against the resolution issued by the Mixed Chamber of the Superior Court of Justice of Madre de Dios, dated October 3, 2016. The Mixed Chamber had declared the lack of object of the controversy, revoked the appealed judgment and declared the claim unfounded. In relation to this aspect, the claim was filed by the appellant of the aforementioned appeal against the president of the Superior Court of Justice of Madre de Dios, Marino Gabriel Cusimayta, and the administrator of the Module of the New Criminal Procedure Code of Tambopata, Margarita Milagros Meléndrez. According to the aggrieved party, these persons would have violated her fundamental rights related to the right to breastfeeding leave and the maximum daily work day, which includes the right to work and the free development of personality. In this instance, the Constitutional Court recognizes the lack of object of the controversy for the appellant. However, it decides to rule on the grievance suffered by the appellant, as well as on the set of rights affected to third parties not related to the appellant and the situation of women in our society. To reach this conclusion, an analysis has been carried out that has included the review of various conceptual sources, such as the Political Constitution of Peru, laws, jurisprudence of the Constitutional Court and relevant academic articles. In accordance with the determination of the Constitutional Court, it is established that pregnancy should not be considered as a valid condition that restricts the exercise of the right to work or other fundamental rights.
