This paper is based on the analysis of Cassation Case 20227-2017 La Libertad, which concerns a lawsuit seeking to declare the superior property right, restitution, and payment for the proceeds of the Cabo Verde property against Juan Jose Hernandez Saavedra, Carla Irian Hernandez Esquen and Ysabel Noemi Hernandez. The Supreme Court has partially granted the plaintiff’s claims; however, there is a dissenting vote allowing examination of both sides regarding the superior property rights. The legal focus of this work is on analyzing the conflict of real rights, specifically the superior property right. Various sources such as books, scientific articles and relevant regulations were consulted to enhance understanding of the conceptual foundations in this legal field. The analysis of the case is based on arguments from the Supreme Court and the minority opinion, enabling us to take an informed stance on superior property right. Particularly, the minority opinion’s rationale supports dismissing the plaintiff’s appeal. It highlights key aspects, such as the invalidity of the second acquirer’s property title and potential bad faith. Therefore, we endorse this position, deeming it appropriate and consistent with the legal and ethical principles governing the matter.
