The work is developed by virtue of Cassation No. 3446-2018 Ucayali, concerning the claim filed by the company International Oil Company Of The Peru Sociedad Anónima Cerrada against Mrs. Elva Trujillo Silva who owned the estates called “Lidia Antonia“ and “Lidia Antonia II“ subject matter of litigation; The Justices of the Supreme Court, by majority vote, agreed to declare the appeal unfounded, ordering the defendant to claim the properties subject to litigation in favor of the plaintiff. For the development of this work, different sources of consultation were taken into consideration such as scientific articles, books and jurisprudence applied to the case, that said, the controversy of the case discussed deals with the analysis of the application of article 2022 of the Civil Code by virtue of the opposability of rights over registered real estate as well as the presumption of good faith. In this sense, we agree with the position of the minority vote that questions the application of article 2022 of the Civil Code, by which the appeal filed by the defendant was determined to be unfounded, arguing that for the application of the opposability of the right of ownership over the real estate subject of litigation, the defendant should have previously registered its right, The right of ownership erga omnes is stated in the private document of sale, which was presented in the first instance and in a notarized copy, a document that endorses the defendant´s fundamental right to property.
