The purpose of this work on professional sufficiency is to criticize the presumption of legality in the termination of employment through dismissal for justified cause against a pregnant woman, and how over the years, various judgment has been taking such form that, currently, overprotection against layoffs is a Peruvian reality that welcomes all pregnant women. As a matter of fact, it was decided to analyze the Ruling of the Constitutional Court Nº00677-2016-PA/TC that develops three rules applicable in case pregnant women demand annulment of dismissal due to their condition, the first rule being the subject of criticism by containing a legal loophole that, given a restrictive interpretation, could disrupt the employer's sanctioning power. To do this, we rely on various sources of consultation such as national and comparative jurisprudence, current regulations, articles by experts and opinions of renowned lawyers in labor matters. Finally, it is concluded that the legality in the dismissal of a pregnant woman must be presumed relatively and not absolutely, since the employer will always have the burden of proving just cause in dismissals due to the commission of a serious misconduct related to conduct or the capacity of your worker. For this reason, it is suggested that at the judicial level, judges in charge of dismissal annulment processes apply a relative presumption of the facts that admit evidence to the contrary, that is, allowing the employer to demonstrate the just reason that motivated the dismissal of the lactating worker or pregnant.
