In this work, Cassation N° 6060-2018- Lima Sur issued by the Permanent Civil Chamber of the Supreme Court of Justice of the Republic will be analyzed, in which a controversy arises due to the violation of some constitutional and procedural rights, the which are, specifically, the right to due motivation of judicial resolutions and the right to defense. That is why, in the first chapter, the events of the controversy and the most relevant foundations developed by the Ad Quem and the Civil Chamber in their considerations are detailed. Subsequently, in the second chapter, we conceptually capture the procedural rights and their fundamental elements, such as due process, the single execution process and judicial discretion, based on doctrine and jurisprudence, which will essentially contribute in the third chapter, where we will analyze the judicial discretion, the feasibility of incorporating extemporaneous evidence, in such a way as to avoid affecting the rights to due judicial motivation and defense, in order to be able to make a proposal for a solution to avoid repeating effects similar to the developed in future controversies.
