By means of the present work of professional sufficiency, the judgment of the Constitutional Court in Case No. 03455-2021-PA/TC will be analyzed, which is developed around a writ of amparo that seeks the non-application of a municipal ordinance to the appellant, because it violates her fundamental rights to freedom of work and commerce. The amparo appeal ended in a favorable result for the appellant with a majority of votes declaring the claim founded and ordering the non-application of the municipal ordinance. In addition, it presents three singular votes with divergent opinions regarding the merits of the claim and the analysis performed. This work focuses on analyzing the violation of fundamental rights to freedom of work and commerce against the constitutional duties of guaranteeing citizen security and promoting the development and local economy of the District Municipality of Miraflores. Likewise, different controversial aspects are developed such as: the legitimacy to act, the fundamental rights and their limitations, the proportionality test, the challenged municipal ordinance and alternative solutions are proposed. Concluding that the municipal ordinance, in spite of having constitutionally relevant grounds and being right in the limitation of the appellant's rights for a greater social good, ends up violating her fundamental rights, due to the way in which it
