This research aims to analyze the impact of Article 20 of the Civil Code. To achieve this, we will consider the pronouncement of the Constitutional Court in Plenary Judgment 641/2021, which pertains to case number 02970-2019-PHC/TC. Regarding this matter, Article 20 of the Civil Code does not explicitly specify the order of precedence that parents should follow when registering their descendants. However, RENIEC (the National Registry of Identification and Civil Status) adopted an interpretative criterion that the paternal surname should prevail over the maternal surname. The central focus of this analysis lies in the interpretative error assumed by RENIEC. They denied the renewal of the ID card to the aggrieved party, JRG, upon reaching adulthood. The denial was based on the order of her surnames, with the maternal surname preceding the paternal one. Undoubtedly, these actions infringe upon the fundamental and inherent rights of every individual, including the right to have one’s name and surnames, to identity, non-discrimination, and equality. In the first chapter, we will present the legal origins of the judgment, along with the differing opinions among the justices. The second chapter will delve into the social reality from both national and international perspectives, considering various theoretical viewpoints. Finally, we will propose improvements based on the insights of specialized authors who advocate for human rights.
