The present work analyzes the Casation No. 3529-2022-Apurímac, which concerns the criminal complaint filed by the aggrieved party D.P.F against the adolescents A.D.P.C and A.H.C.C for the commission of the infraction of Serious Injuries. The Supreme Collegiate Court determined the responsibility of both adolescents as co-authors. The legal subject matter of the case is criminal law, as the case concerns the infringement of articles 393 (2), 394 (2) and (3), and 397 (1) of the Code of Criminal Procedure, regarding due motivation and the principle of appellate congruence, and article 23 of the Penal Code, regarding co-authorship. Therefore, the main objective of the work is to determine and analyze the scope and implications of co-authorship and additive co-authorship in the infringing acts. In this sense, the content focuses on essential aspects of the Adolescent Responsibility Code, the types of co-authorship, and the implications of additive co-authorship, institutions not thoroughly developed in criminal law but addressed by doctrine and jurisprudence. It is concluded that, in the case of attribution of infringing acts as co-authorship, and specifically in the case of additive co-authorship, it is necessary to resort to the Penal Code applicable to adults, without implying that adolescents are judged under that normative framework; likewise, it is essential not to limit oneself to a purely normative analysis but to conduct an analysis from a doctrinal and jurisprudential perspective.
