In October 2023, the official newspaper El Peruano published the Cassation Judgment No. 18519-2021 issued by the Permanent Chamber of Constitutional and Social Law of the Supreme Court (hereinafter, the Chamber). The aforementioned judgment determined that there is no risk of confusion or association between two phonetically similar trademarks that distinguish products or services of the same class, due to the level of perception of their consumers and other elements considered as differentiators. This paper work proposes a critique of Cassation Judgment No. 18519-2021 and the questionable grounds used by the Chamber to reach its final decision. The first chapter will provide a detailed summary of the judgment, specifying the background and highlighting the issue of debate. Likewise, the criteria used by the members of the Chamber to reach the final decision will be presented. On the other hand, the second chapter will develop the conceptualization of the trademark as a distinctive sign and its main functions. Additionally, the concept of trademark confusion and the criteria for the comparative examination will be explored. Finally, the third chapter will conduct a legal analysis of the aforementioned judgment based on the criteria for conducting a comparative examination between two trademarks and determining whether their coexistence is likely to cause confusion among consumers.
