This study was developed with the objective of analyzing the influence of limitations in national educational regulation on the protection and guarantee of the principle of the best interests of the child in the context of blended families in Peru. Using applied research, the study approached the problem from a mixed approach, combining qualitative and quantitative methods through a non-experimental, descriptive and correlational design. The sample consisted of 15 lawyers specialized in civil and family law selected for their relevance in the analysis of the legal application of the principle of the best interests of the child in the educational context. Data were collected through questionnaires applied to the expert lawyers. The results indicate that current Peruvian educational legislation does not effectively recognize and apply the principle of the best interests of the child for children of blended families, resulting in insufficient protection of their educational rights. This finding underscores the need for legal reforms that prioritize the protection of the rights of these children and ensure their well-being and integral development in the Peruvian educational system.
