The present work of professional sufficiency, focused on analyzing the Plenary Casatorio N°191/2022, related to the situation of legal lack of protection of constitutional rights of people of the same sex who still cannot marry in Peru. In this sense, the first chapter develops the summary of the case, the most outstanding grounds and the analysis of the votes of the judges of the present judgment. In the second chapter, the relevant conceptual bases for the study are exposed, such as marriage in the Peruvian legal system, equal marriage in comparative law, and the constitutional rights alleged. In the third chapter, a legal analysis is made of the lawsuit filed for the constitutional grievance for the non-recognition of marriage between same-sex couples. In this regard, in consideration of the norms, jurisprudence and doctrine, it is concluded that the Constitution is not restrictive, and would allow a broad interpretation of the norm to recognize equal marriage. In this context, it is considered that there was an inadequate interpretation of the legislation by the magistrates who voted in the majority for the non-recognition of equal marriage in our Peruvian legal system, therefore, it is recommended that article 234 of the Civil Code of 1984 be amended in order to guarantee constitutional rights in defense of individuals and respect for their dignity, regardless of their sexual orientation.
