The purpose of this paper is to carry out a critical analysis of the ruling by the Constitutional Court in the Judgment N° 00949-2022-PA/TC, which addresses the issue related to the prohibition of pet ownership in a vacation condominium, producing a conflict between the fundamental rights to the free development of personality and the contractual freedom by virtue of the autonomy of the will. In this sense, the main legal institutions involved in this case will be developed, resorting to the regulation of our legal system, jurisprudence, doctrinal opinions and comparative law, among other sources. Having carried out this analysis, it is concluded that the decision adopted by the majority suffers from serious deficiencies in its reasoning, such as the lack of a convincing justification that supports the difference between this case and the one resolved, in the opposite direction, in the Judgment of File N° 01413-2017-PA/TC. Furthermore, it is concluded that in situations of conflict between fundamental rights it is imperative to employ the Proportionality Test, in order to provide a duly argued solution, which allows the eventual restriction of a right under the parameters of reasonableness and proportionality.
