The present work is based on the analysis of the sentence issued by the Constitutional Court (CC) in the framework of the discussion in Case 00002-2020-CC/TC, which deals with a competence claim filed by the Executive Power against the Legislative Power in which the CC is requested to rule on the improper use of the competence to declare the presidential vacancy due to permanent moral incapacity, since it affects the competence of the President of the Republic to govern the general policy during the five-year period, for which he has been elected, and the competence of the ministers to execute said policy during the same period. Although the majority vote of the Magistrates of the CC concludes in declaring the claim IMPROCEDENT due to the subtraction of the matter, the sentence reveals the existing ideological and conceptual discrepancies on how the cause of permanent moral incapacity should be understood for the vacancy of a president, an aspect that will be analyzed in this paper. In the preparation of this research, bibliographic sources specialized in the subject have been consulted. These resources have supported our position that the lawsuit should be declared inadmissible, since we consider that there was subtraction of the matter in the present case and that the figure of permanent moral incapacity must be understood as an open and indeterminate cause that supposes a lack of ethical suitability due to serious conduct contrary to the dignity of the presidential office.
