The present work of sufficiency focused on analyzing Cassation No. 349-2019, which deals with the execution of a public deed of the purchase and sale contract executed verbally, between the siblings María Laurencia Alama Maza de Cueva and Hortencio Alama Maza. Therefore, the first chapter developed the most relevant grounds of Cassation No. 349-2019 and analyzed the evidence presented by the plaintiff in order to determine whether there was a verbal purchase and sale agreement and whether the execution of the public deed is appropriate. On the other hand, in the second chapter, the most relevant legal concepts regarding the real estate transfer system in Peru, the legal security that this system grants and the purchase contract, among others, are developed. Finally, in the third chapter, the system of transfer of real estate properties in Peru was analyzed, as well as in the comparative doctrine in order to determine whether or not this system grants legal certainty in the Peruvian legislation. In this sense, it is concluded that the property transfer system in Peru generates risk situations in the transfer of real estate, since the consensual system does not stipulate a formality that the contractual parties must comply with as a configuration requirement for the transfer of ownership.
