This paper sets out and analyses Sentence 785/2021 issued by the Constitutional Court in Case No. 00374-2017-PA/TC, which resolves the constitutional appeal for protection filed by Kimberly Chapoñan Meza's lawyer against the decision issued by the Fifth Civil Chamber of the High Court of Justice of Lima, which declared the nullity of the appealed sentence, void everything that had been done and declared the lawsuit inadmissible. Consequently, the appellant requests that the Tribunal declare the following resolutions null and void: (a) Resolution Directoral N° 0566-2014-MGP-DGP dated 02 July 2014, which provides for the separation and discharge of the aggrieved party from the High Naval Technological Institute, for psychophysical unfitness due to psychosomatic origin; and, (b) Resolution of the General Command of the Navy No. 0563-2014-CGMG dated 04 September 2014, which declares unfounded the appeal, filed by the affected party against the directorial resolution previously referred to. The analysis of the case involves assessing whether it is feasible to deprive a pregnant woman who is attending military training institutes of her right to education To arrive at the analysis and conclusion, various sources have been consulted, including regulations, books and/or book chapters and scientific articles. The majority vote of the Constitutional Court agrees with our conclusion, since pregnancy does not constitute a valid assumption that limits the right to education and equality.
