Abstract: En un entorno de creciente regulación estatal, existe la creencia de que esta proliferación normativa se traduce en una mejora en la protección de los derechos de las personas. Sin embargo, un exceso de regulación puede conducir una carga administrativa innecesaria a los administrados que, a su vez, puede desalentar a recurrir al Estado en aras de salvaguardar sus derechos.
En efecto, tenemos que la complejidad regulatoria puede generar incertidumbre y costos lo que dificulta su aplicación efectiva; de manera que, su objetivo se ve desvirtuado lo que reduce su impacto positivo.
En ese sentido, mediante Acuerdo N° 006-2019, el Tribunal de la Superintendencia Nacional de Salud, acordó oficiar al Ministerio de Salud, a fin de promover la emisión de una ley para aquellos hechos en los cuales se han afectado los derechos del usuario, en procedimientos trilaterales sancionadores, específicamente en casos en el que el extravío de la historia clínica limite el ejercicio de su derecho, en aras de regular la inversión probatoria, lo cual tiene como objeto que la Instituciones Prestadoras de Servicios de Salud, aporten al proceso material probatorio que les permita acreditar la ausencia de responsabilidad en la producción del daño.
Al respecto, el presente Trabajo de Suficiencia Profesional analizará si lo acordado en el Acuerdo N° 006-2019, requiere que el MINSA genera una nueva normativa o si la normativa peruana existente cumple plenamente la finalidad que permita a la autoridad sancionadora utilizar los mecanismos ya establecidos para la inversión probatoria en un procedimiento trilateral sancionador.
In an environment of increasing state regulation, there is a belief that this regulatory proliferation translates into an improvement in the protection of people's rights. However, over-regulation can lead to an unnecessary administrative burden on those administered, which, in turn, can discourage them from turning to the state for the sake of safeguarding their rights. Indeed, regulatory complexity can generate uncertainty and costs, which makes it difficult to apply them effectively; In this way, their objective is distorted, which reduces their positive impact. In this regard, through Agreement N° 006-2019, the Court of the National Superintendence of Health, agreed to officiate to the Ministry of Health, in order to promote the issuance of a law for those events in which the rights of the user have been affected, in trilateral sanctioning procedures, specifically in cases in which the loss of the medical record limits the exercise of their right, in order to regulate the evidentiary investment, which has the purpose that the Institutions Providing Health Services contribute to the evidentiary material that allows them to prove the absence of responsibility in the production of the damage. In this regard, this Professional Sufficiency Paper will analyse whether the Agreement N° 006-2019 requires the MINSA to generate a new regulation or if the existing Peruvian regulations fully comply with the purpose that allows the sanctioning authority to use the mechanisms already established for the evidentiary investment in a trilateral sanctioning procedure.
