La legítima sucesoria frente al patrimonio fiduciario testamentario en el Perú

Abstract

El título del estudio es “la legítima sucesoria frente al patrimonio fiduciario testamentario en el Perú”. El problema identificado es la existencia en la doctrina de una asimilación interpretativa entre la intangibilidad de la legitima y la que corresponde al patrimonio autónomo del fideicomiso testamentario regulado por la norma peruana. En ese sentido, su objetivo es el de determinar la distinción jurídica entre la intangibilidad de la legítima y del patrimonio fideicometido en el fideicomiso testamentario en la norma peruana. Los resultados generados desde un enfoque metodológico cualitativo-hermenéutico examinaron la naturaleza jurídica de ambas figuras legales, como una estrategia de formulación de criterios distintivos orientada a mantener salvaguardados derechos fundamentales.

The title of the study is "the legitimate succession against the testamentary fiduciary heritage in Peru". The problem identified is the existence in the doctrine of an interpretive assimilation between the intangibility of the legitimate and that which corresponds to the autonomous estate of the testamentary trust regulated by the Peruvian norm. In this sense, its objective is to determine the legal distinction between the intangibility of the legitime and the trust property in the testamentary trust in the Peruvian norm. The results generated from a qualitative-hermeneutic methodological approach examined the legal nature of both legal figures, as a strategy for formulating distinctive criteria aimed at maintaining fundamental rights safeguarded.
