Abstract: En la sentencia N° 00688-2020-PHC/TC emitida por el Tribunal Constitucional con fecha 12 de junio del 2022, versa sobre el debate inmerso en la medida impuesta por el gobierno peruano, referida a la exigencia de la visa como requisito de acceso al Perú partir del 15 de junio de 2019. A razón de ello, se interpone una demanda de habeas corpus a favor de los ciudadanos venezolanos, que pretende el cese de la medida restrictiva puesto que consideran que dicha medida adoptada por el gobierno peruano vulnera y/o amenaza sus derechos de libertad de tránsito, a solicitar refugio, igualdad y no discriminación, y los derechos de los niños y adolescentes.
Previo al análisis de la casuística, se abordará conceptos necesarios para entender la situación materia de litis, primero, el habeas corpus colectivo, su origen y desarrollo internacional, como su posterior aplicación en el Perú a nivel jurisprudencial, luego algunas aproximaciones a los instrumentos internacionales en función a los inmigrantes y, por último, una breve introducción sobre el poder del Estado en materia migratoria y su regulación constitucional.
Bajo este contexto, en el análisis jurídico del caso se evaluará temas procesales, como la procedencia de la demanda a favor de un colectivo ubicado fuera de las fronteras peruanas, y de fondo, la referida a la restricción de derechos fundamentales sustentada en la soberanía del Estado y sus excepciones a la medida en el marco de la normativa nacional y los instrumentos internacionales de derechos humanos.
In ruling No. 00688-2020-PHC/TC issued by the Constitutional Court on June 12, 2022, it deals with the debate immersed in the measure imposed by the Peruvian government, referring to the visa requirement as an access requirement. to Peru as of June 15, 2019. As a result, a habeas corpus claim is filed in favor of the Venezuelan citizens, which seeks the cessation of the restrictive measure since they consider that this measure adopted by the Peruvian government violates and /or threatens their rights to freedom of movement, to request refuge, equality and non-discrimination, and the rights of children and adolescents. Prior to the analysis of the casuistry, concepts necessary to understand the situation subject to litigation will be addressed, first, the collective habeas corpus, its origin and international development, such as its subsequent application in Peru at a jurisprudential level, then some approaches to international instruments. based on immigrants and, finally, a brief introduction about the power of the State in immigration matters and its constitutional regulation. Under this context, in the legal analysis of the case, procedural issues will be evaluated, such as the origin of the claim in favor of a group located outside the Peruvian borders, and in substance, that referring to the restriction of fundamental rights based on the sovereignty of the State and its exceptions to the measure within the framework of national regulations and international human rights instruments.
