In this investigation, the Labor Cassation No. 49503-2022-LIMA dated March 9, 2023 will be analyzed, where the Supreme Court protected in favor of Edwin Lucio Cristóbal Jave the economic benefits of rationing, mobility and pre-schooling established in the fourth point of the operative part of the 2014 Arbitration Award, which resolved the 2013-2014 collective bargaining between the Metropolitan Municipality of Lima and the Lima Municipal Workers Union - SITRAOML. The instruments used to carry out the analysis of this cassation ruling were academic articles, theses, books, specialized magazines, jurisprudence and the laws applicable to the specific case. In this way, this work will oversee developing the types of clauses present in collective agreements, the application of the most favorable norm and the criterion of binding force, as well as the denaturalization of non-remunerative concepts, applying the principle of primacy of reality if fraud against labor standards is perpetrated. Finally, after carrying out an exhaustive analysis, it will be concluded that the arguments specified by the Municipality are not adequate and that the Supreme Court did not develop the crucial issues to resolve the object of controversy: the delimiting clauses in the collective agreement, and the legal nature of the working conditions, which represents a fundamental aspect in order to determine whether the claimed benefits should be granted to the plaintiff, or if not, be rejected.
