This work will analyze what was issued in the plenary session of sentence 104/2022 on March 15, 2022, issued by the Constitutional Court from file 03204-201-HC/TC where Carlos Enrique Arbulu Chanduvi presented a Habeas Corpus recourse in favor of José Manuel Albuquerque Aldea where Judges Ferrero Costa, Sardón de Taboada (speaker) and Blume Fortini voted to declare the Habeas Corpus claim FOUNDED. On the other hand, judges Miranda Canales, Ledesma Narváez and Espinosa Saldaña Barrera voted to declare said claim UNFOUNDED, which unleashed a binding precedent regarding Judges and representatives of the Public Ministry (provincial prosecutors and superiors). Regarding judges, they refer to their power to limit their actions to what the highest-ranking representatives of the Public Prosecutor's Office request. Regarding the prosecutors, a precedent is left regarding their ranking and how the provincial prosecutors must act according to the criteria of the superior prosecutors. Furthermore, what was issued in the individual votes of each judge who voted UNFOUNDED will be analyzed, since they state that although it is true that the Judiciary is independent, the Public Prosecutor's Office, by applying the principle of hierarchy, is minimizing and devaluing the actions of the lower-ranking prosecutors.
