The purpose of this work is to analyze and clarify the different discussions that have been had regarding the correct interpretation of article 5 of Law 30313, “Law of opposition to the registration procedure in process and cancellation of the registration entry due to identity theft or falsification of documentation and amendments to articles 2013 and 2014 of the CC.” and articles 4 and 55 and the Fifth and Sixth Transitional and Final Complementary Provisions of the D.L. 1049, because the implementation and application of said regulatory bodies are interpreted incorrectly, by shielding and benefiting third parties in good faith from registration registrations carried out fraudulently and illicitly through false titles or where there would have been identity theft, leaving in helplessness to the real owners of the property, being deprived of the legitimate property. Therefore, it is appropriate in this work to analyze and validate the claim presented in order to determine whether the application of said terms expressed in the norm observed in the investigation should be considered unconstitutional and whether this violates the principles of public faith and the property rights. Under these considerations, we must clarify who has a better preferential position? The third party in good faith or the legitimate owner when there is a registration on the property due to false title or identity theft? With this we will try to answer the duly supported questions
