In this professional project, the group are going to analyze a ruling 973/2021 from the Constitutional Court relating to Habeas Corpus in which the violation of the right to the presumption of innocence as a right related to individual freedom was mainly alleged and analyzed. Thus, in the first two instances, the claim was declared inadmissible; while the Constitutional Court declared the claim founded. The Court's ruling ordered that the National Police and other entities refrain from exposing the detainees in press conferences, as long as there is no final conviction. For the development of the Project, biobibliography international and national were used, the objective is to establish the relationship between the right to the presumption of innocence and the exposure of detainees in press conferences even when they are not directly accused of guilt. In the end, considering the information obtained, the conclusion is proposed that exposing detained persons at a press conference linking them to a crime violated seriously the fundamental rights in all the people.
