To date, numerous cases related to the name change process have been observed, and along with them, issues have arisen regarding the procedural path chosen by judges to resolve the petitioner's request. However, due to the absence of a clearly defined process that must be employed, this creates an atmosphere of uncertainty. Hence, the present work examines the name change process in cassation appeal No. 1018-2020. Given the current circumstances, it is imperative to delve into such claims. The occurrence of such a scenario results in the violation of fundamental rights, including due process, judicial protection, and the right to defense, all of which are analyzed in the subsequent sections. In the course of this research, sources such as legal doctrine and jurisprudence were utilized, which are reflected through electronic books, journals, civil cassation cases, and judgments from the Constitutional Court. From the analysis conducted, it can be inferred that in cassation appeal 1018-2020, filed by Modesto Galindo Cuchuñaupa, clearly protected rights under our Constitution have been violated. In this particular case, one branch of the State seems to have acted in contradiction to what is expected, as, in our understanding, the judiciary is supposed to be the guardian of justice and the protection of our rights.
