This case deals with a divorce on the grounds of de facto separation. Said proceeding was initiated in 2015 by Mr. J.A.N.R. against his spouse, Mrs. J.M.V. de N., in which he requested the judge to declare the dissolution of the marriage by cause, as well as to exempt him from alimony in favor of his spouse. Mrs. J. M. V. de N. answered the lawsuit, requesting the judge not to stop the alimony, since she was in serious health condition, as well as to grant her an indemnity for being the spouse most harmed by the separation. In this sense, the judges of the first and second instance verify the existence or not of the injured spouse, and the corresponding compensation, as well as analyzing whether or not the alimony should be maintained or not. Finally, the Supreme Court established its position on the possibility of reviewing the merits of the controversy through an appeal in cassation.
