The judgment of the VIII Plenary Court of Civil Cassation was published on September 20, 2020 in the official newspaper “El Peruano“, in which the judges of the Supreme Court decided with a majority vote, five (5) votes, that the legal act generated by the act of disposition of a social asset made unilaterally by one of the spouses should be declared null and void according with the Article 315° of the Peruvian Civil Code; while the remaining four (4) judges, representing the minority vote, argued that the said act should be declared ineffective. In this context, since there is no single thesis to resolve this conflict; this work of professional sufficiency will evaluate why the legal act generated by the act of disposition of a social asset made in a unilateral manner by one of the spouses should be declared only ineffective or null and void, as decided by the majority vote in the judgment of the VIII Plenary Civil Cassation. The evaluation of the conceptual framework and the legal consequences of the thesis of nullity and ineffectiveness developed in the judgment of the VIII Plenary Court of Civil Cassation will be carried out, taking into account national jurisprudence and doctrine, in order to point out why the thesis of ineffectiveness is the most appropriate to protect the interests of all parties involved and pretermitted in the generated legal act, specifying also what are the disadvantages of opting for the thesis of nullity.
