This work focuses on the impact of Ruling 313/2022 of the Constitutional Court of Peru on the Complementary Risk Insurance (SCTR) system and credit relief insurance. The ruling establishes a binding precedent that redefines the valuation of the right to a pension in the Peruvian context and raises challenges to protect social security rights, and redefines the obligations and responsibilities of insurers in relation to SCTR and credit life insurance. The study begins with a review of previous legislation and jurisprudence in relation to SCTR and credit insurance in Peru, highlighting existing limitations and deficiencies. Then, Sentence 313/2022 is analyzed in detail, identifying its legal and practical implications in the assessment of the right to a pension. The investigation evaluates how this ruling affects both the pension rights of policyholders and the impact of insurance companies in Peru. In addition, recommendations are proposed to address the challenges arising from this precedent and ensure effective protection of pension rights, in accordance with current regulations. This thesis contributes to the understanding of the intersection of social security and insurance in Peru in the context of Ruling 313/2022, as it addresses legal and practical challenges that affect insurance companies, regulatory compliance, risk management and the experience of the insured.
