In this paper, we address a specific case that necessitates a significant change in the current Peruvian legislation through Full Judgment 50/2023, falling within the realm of civil law and more precisely, the law pertaining to individual identity and equality. This case stands out because our legislation does not provide for an explicit hierarchy regarding the order of surnames. Therefore, we seek a legislative reform with the aim of preventing the violation of the right to equality and non-discrimination based on gender. We have considered developing the impact on the right to equality and non-discrimination and how this affects the right to identity as a consequence of the application of the current Article twentieth of the Civil Code, which does not specify an order for the registration of surnames. For the present work and research development, we have referred to both national regulations and comparative legislation. We have also considered relevant legal articles on the right to identity, equality, and non-discrimination, drawing on what has been expressed by the Constitutional Court. The choice of the judgment is justified by its importance in the current context, as it seeks to eradicate practices that undermine equality and non-discrimination, as well as to allow choice in the order of surnames, without infringing on fundamental rights.
