The present work of professional sufficiency develops an analysis regarding the importance of guarantees in Peru and their execution according to the current legislation; especifically, in the case of extrajudicial collateral. All this within the framework of the applicable regulations on the matter. For this purpose, it is considered that the value of a good varies as time goes by; reason for which the appraisal is a necessary tool in order to accurately establish the price of a certain object, especially if it will be sold and subsequently registered as a consequence of its delivery as extrajudicial collateral (such as a pledge). In this sense and in order to fully analyze the selected legal figure, we will proceed to analyze Resolution No. 210-2023-SUNARP/PT and its supporting Resolutions, since the first mentioned resolution established a precedent of mandatory observance in the matter of extrajudicial collateral. Therefore, by means of a doctrinal and jurisprudential analysis in civil matters, this work intends to promote a better understanding of the legal figure analyzed and, thus, to understand the relevance of Resolution No. 210-2023-SUNARP/PT as a precedent of mandatory observance.
