The main purpose of this work is to analyze the consequences of null dismissal in the current Peruvian jurisdiction, where the relevance of each of them will be emphasized and will take as an example Exp.N°18285-2019-0-1801-JR-LA- 11, since this will serve as a comparison, as it will demonstrate the application of Emergency Decree No. 016-2020, the same one that was repealed in 2021. The aforementioned decree was declared unconstitutional, because it constituted a violation of constitutional rights. of public sector workers. Likewise, the analysis will be made of the evolution of the New Labor Procedural Law, which, its main objective, is to safeguard the rights of workers in the Peruvian public sector. For this reason, a distinction is made between public and private workers, where we focus on developing the lack of protections that State workers face when they are fired without legitimate cause. Thus, through consulted sources we will address concepts, doctrine, jurisprudence and critical analysis of the unconstitutionality of numeral 2 of section 3.3 of article 3 of Emergency Decree No. 016-2020, since this decree showed the importance of the role that Labor judges have their hands in their hands, given that they are the ones in charge of applying the laws. Finally, we conclude with a reflection about the New Labor Procedural Law and how, by not conceiving the article of the repealed decree, it generates the reliability of public sector workers in the Peruvian legal system.
