This paper analyzes prior consultation and its status in Peru, based on the pronouncement of the Constitutional Court, in the Plenary Ruling No. 027-2022, which erroneously interprets that prior consultation is not a fundamental right and does not correspond to its protection by the action of amparo. As a result, this paper seeks to present the legal arguments regarding prior consultation as a fundamental right and its importance in guaranteeing the protection of indigenous peoples and communities. It also criticizes the uniquely pluricultural recognition of indigenous peoples and communities in the Peruvian legal system, the Law on Prior Consultation and its ineffectiveness and inefficiency in establishing a dialogue that leads to consensus among the interests of the different participants. Finally, a comparison is made with the Colombian model and the need to establish a new vision of prior consultation in the Peruvian State.
