This report is prepared in reference to case file number N. º 04324-2018-PA/TC issued by the Constitutional Court, reviewing the Constitutional Remedy interposed by don Renato Medina Valdivieso, lawyer of don Danny Angello Rodríguez Lira, who has been affected by not obtaining a motivated decision. The actress in an action of protection against the Supervising agency for state contracts (OSCE), requested that he be restored to full enjoyment of his right to participate in the selection and contracting processes with the State, both on a personal level, and as a shareholder, owner, or participant in legal entities, alleging that the defendant entity would be violating his right. to the freedom of contracting to the extent of the provisions of section k, of article 10 of the Law on Contracting with the State (DL 1017). This file evaluates whether the plaintiff's right to freedom of contract was violated, to the extent that it prohibits him from applying in selection and contracting processes with the State to legal entities that have certain members of other legal entities that have been sanctioned with definitive disqualification. In this case, the Constitutional Court will analyze whether the fundamental rights of Mr. Danny Angello Rodríguez Lira were violated and apply the law as appropriate as the highest interpreter of the Constitution.
