The objective of the following work is to analyze the Cassation 10189 - 2021 issued by the Permanent Constitutional and Social Law Chamber of the Supreme Court of Justice of the Republic, dated September twentieth, two thousand and twenty-three, on the authorization of the civil procedure regarding the registration of a title that comes from an administrative venue. The research work has focused on objecting to the decision taken by the Court regarding its position of allowing civil proceedings in cases of nullity of an administrative act, since we have an adequate way to question the validity of these acts, the Contentious Administrative Process. When this scenario arises, important instruments in the legal system such as due process, the principle of specialty, the exclusivity of the administrative procedure, among others, are infringed. Thus, for the development of the present case, several sources have been used, such as; norms that develop the contentious administrative procedure, the legal act and our Magna Carta; jurisprudence that contain relation to the position presented; national doctrine that refers to issues of the present controversy, such sources have been of support to be able to analyze this investigation. After the analysis of the present case, it is concluded that the suitable procedural route for the case in question is the contentious-administrative process, since the figure of an infringement to the effective jurisdictional protection as indicated by the Court is not fulfilled, since there is an established norm that protects this right in a sufficient manner.
