This study deals with the 2022 National Family Jurisdictional Plenary, hereinafter the Plenary, regarding the beginning of the expiration period of the divorce process due to physical and psychological violence, which is drafted in 339° of the Civil Code. The topic to be developed deals with when the legal term created by the plenary of the commencement of the expiration period should be understood to be applicable when the victim has overcome the gender barriers. This research performs a dogmatic analysis in Family matters using sources of national and foreign doctrine, and constitutional jurisprudence on the concepts of expiration, predictability, the meaning of overcoming gender barriers to propose a concrete proposal for the application of the term by the magistrates. This work was selected because, the Plenary has unintentionally created a new question regarding when the gender barriers should be understood as overcome in order to start the expiration term on divorce on the grounds of psychological and physical violence, since the plenary fails to give objectivity to the legal figure for its correct concrete application by the magistrates at the national level.
