Abstract: La sentencia materia de análisis aborda una problemática muy particular pues se encuentra enfocada en verificar si existe alguna vulneración a los derechos fundamentales, tales como el libre desarrollo de la personalidad y el libre tránsito, en aquellos casos que dentro de los límites de una edificación donde exista propiedad horizontal se llegue a prohibir la tenencia de mascotas. En esa línea, el objetivo del presente trabajo es ahondar en los conceptos de mayor importancia que fueron materia de estudio al elaborar la parte resolutiva de la sentencia, así como también los votos singulares donde se expusieron criterios particulares. Asimismo, se estudiará si los hechos responden a una efectiva lesión a los derechos fundamentales y si existen principios como la autonomía de la voluntad que pueda suponer un límite a los mismos. Las fuentes bibliográficas utilizadas constan de libros y artículos académicos que abordan con mayor minucia los principales conceptos del tema de investigación. De igual forma, se ha tomado en cuenta la normativa y jurisprudencia nacional donde exista una referencia a nociones similares. Finalmente, se expone la necesidad de incorporar dentro del acervo normativo nacional alcances específicos sobre los límites que deben respetarse cuando se requiera exigir el cumplimiento de medidas prohibitivas respecto a la tenencia de mascotas.
The judgment addresses a very particular problem as it is focused on verifying whether there is any violation of fundamental rights such as the free development of the personality and the free movement. In those cases that within the limits of a building where there is horizontal ownership the possession of pets is prohibited. In this respect, the objective of the present work is to go deeper into the most important concepts that were the subject of study in the drafting of the resolution of the judgment, as well as the individual votes where particular criteria were set out. It will also examine whether the facts represent an actual infringement of fundamental rights and whether there are principles such as the autonomy of the will that may constitute a limit to them. The bibliographic sources used consist of books and academic articles that deal more thoroughly with the main concepts of the research subject. Similarly, national legislation and jurisprudence where a reference to similar notions exists has been taken into account. Finally, the need to incorporate into the national acquis legislation specific limits on the limits to be respected when prohibitive measures regarding the possession of pets are required to be complied with is raised.
