The purpose of this paper is to analyze and determine whether it is legally feasible to incur and punish the violation of the duty of suitability in a repeated manner in the same consumer relationship, due to Cassation Ruling No. 31203-2019, which resolves the dispute arising between the National Institute for the Defense of Competition and Protection of Intellectual Property and the company Diveimport S.A., since the former, argued in administrative proceedings such possibility. For the referred purposes, the relevant grounds made by the Supreme Court in Cassation are analyzed, also through the review and analysis of academic sources and legal doctrine, consisting of legal articles of the main academic journals in Law, and legal works of specialty, The conceptual bases necessary for the correct understanding and analysis of the subject are developed, such as the development of the concept of Consumer Relationship and its components, the duty of suitability in consumer protection matters, the principle of Reasonableness, as well as the Constitutional principle and the administrative sanctioning law ''Ne bis in idem'', in order to determine whether or not it is legally possible to impose multiple sanctions for violation of the Duty of Suitability. Finally, the current consumer protection legislation is being analyzed, As part of the conclusions, we maintain that the Duty of Suitability can only be transgressed on one occasion by the supplier. Likewise, we conclude that stating otherwise means violating the principles of Typicality and Ne bis in Idem.
