This research focused on how exclusivity clauses in concession contracts with the State can trigger bureaucratic barriers and difficulties that threaten free competition. The company CERTIPLUS PERU EIRL tried to apply to the Ministry of Transport and Communications (MTC) for an operating license for a Vehicle Technical Inspection Centre (CITV), which was denied due to the existence of an exclusivity clause in the concession contract between the company LIDERCON PERU SAC and the Metropolitan Municipality of Lima (MML). As a result, CERTIPLUS PERU EIRL filed a complaint before the Commission for the Elimination of Bureaucratic Barriers of INDECOPI, alleging the existence of the aforementioned exclusivity clause. In the first instance, INDECOPI declared that there was indeed an illegal bureaucratic barrier and that there was no legal impediment to deny the authorization to operate a CITV. The MTC appealed, as the entity considered that the exclusivity clause of the contract was being violated. Finally, in the second instance, the decision of the first instance was ratified. In this sense, in accordance with the jurisprudence, regulations and doctrine of consultation, it is concluded that there is an illegal bureaucratic barrier based on an exclusivity clause in contracts with the State, which threatens free competition.
