The case in question is the subject of a writ of amparo for unwary dismissal, which arrived at the Constitutional Court through a constitutional complaint filed by the defendant after the second instance declared the claim unfounded; involves as research topics: (1) the determination of the parallel path equally satisfactory or whether the amparo process meets the residual criterion; (2) the determination of the suitability of the modality contract initiated by the plaintiff; by analysing the objective cause which I submit as justification for the use of the modal contract, finally, (3) the determination of the constitutional and legal support of the replacement of labor as a legal consequence against the arbitrary dismissal, according to the hegemonic economic model. On the sources consulted, research articles from the SCOPUS database were used, as well as books from the ELIBRO database, finally, quotations from national laws and the Constitution were used. In conclusion, the following conclusions were reached: (1) the appropriate path for the case below analysis is the amparo process, although it does not meet the residual criterion, since there is a parallel path equally satisfactory, due to criteria of institutional conjuncture, it was necessary to opt for amparo, (2) the contract of employment that the defendant should have employed was a contract for necessity of market, in such sense, they had to declare the claim founded for having distorted the contract subject to modality.
