In this work, a ruling from the Constitutional Court will be analyzed that decided to declare inadmissible a claim for protection, through a constitutional grievance appeal, which deals with the rejection of the registration of a same-sex marriage in the RENIEC, based on the fact that only marriage between a man and a woman is permitted, as established in article 234 of the Civil Code. In this context, in the first instance the claim was declared founded and in the second instance it was decided to declare the nullity of everything that had been done. In this sense, the subject of investigation is the aforementioned ruling of the Constitutional Court, in which fundamentals were presented mainly of form, evidencing the violation of article 2.2 of the Political Constitution of Peru, which establishes non-discrimination and equal treatment. For this reason, we resorted to the doctrine, the Universal Declaration of Human Rights, the Inter-American Court of Human Rights, considering the constitutional and legal framework (Civil Code). Finally, we can conclude that the ruling of the Constitutional Court develops correct foundations; however, We find positions that we do not share, given that the opportunity would be denied to homosexual couples in recognition of their life as a couple compared to others who can freely exercise it; For this reason, the Constitutional Court must have greater reservation in its pronouncements when, through them, it limits or restricts the rights of a minority but equally important sector in society.
