In this work analyzes the recognition of a civil marriage between two women that was officiated outside the country, Peruvian Institutions faced a legal dilemma. Having difficulties when considering the inclusion of the union in the National Registry. The interested parties filed a lawsuit against RENIEC's refusal to register. Despite an initial decision in favor of the plaintiffs, the subsequent decision annulled the verdict, supporting the position that only the registration of marriage between people of opposite sexes is permitted. The legal discourse focused on claims of non-discrimination and equal treatment before the law, highlighting the discrepancy if this fact goes against our Public Order. For this research, different doctrinal sources were used, such as the book Treaty of International Law by Alfonso Calvo and Javier Carrascosa, jurisprudence of international organizations and treaties. Finally, we maintain that this refusal to register is discriminatory and that said request does not violate our Public Order which is based on general principles. In addition, we propose a legislative change, precisely to art. Nº234 of the Peruvian Civil Code, as it is contrary to Peruvian Public Order.
