This work has been developed based on what was resolved in the Cassation ruling No. 1755-2020/Lima, regarding the legal matter of family law such as possession and custody of minors. In this sense, the implementation of the advance assignment of visitation regime emerges as a regulatory proposal, as a new legal figure in family judicial proceedings, to avoid the breakdown of the paternal-filial bond. To this end, national and foreign doctrine was used as consulted sources regarding issues of possession, visitation regime, parental authority, among others; as well as jurisprudence and legal norms that will serve as support for the development of the research topic, were also used. All of this with the purpose of obtaining a normative incorporation within the Code of Children and Adolescents where it is evidenced as a new preventive mechanism to avoid the breakdown of the family bond, prioritizing the best interests of the child so that they continue living in an environment oriented towards their well-being, integral development, and dignified life. Likewise, this new legal figure, being temporary in nature and granted from the order admissing the claim, guarantees the adequate effective jurisdictional protection that every person presents when exercising their right of action. Therefore, it has been concluded that this regulatory proposal would be appropriate within the third book - Family Institutions as it would be granted before the judge issues his ruling.
