The study was prepared based on File No. 14442 - 2021 that was submitted in consultation to the Constitutional Chamber of the Supreme Court, which revolves around the non-application of mercy killing established in article 112 of the Penal Code. The case represents a benefit for the academic community because it focused on the analysis of the decision adopted by the Constitutional Court when disapplying the article. The constitutional claim for protection presented seeks to respect the fundamental rights of Ana Milagros Estrada Ugarte, due to the incurable disease she suffers, and requests that euthanasia be practiced, which is a means through which she can exercise the right to dignified death. The foundations of the study arise from the analysis of indexed journals, theses, books and other works focused on human dignity, and how the exercise of this serves as the basis for the position that proposes the modification of mercy killing, because it affects fundamental rights such as dignity. human, personal freedom and self-determination. Therefore, considering the different legislation regarding the non-criminalization of mercy killing and the application of euthanasia, it is necessary that Peruvian legislation adopt a position in favor of those who suffer from incurable diseases and express their will not to prolong a life that They no longer consider it worthy, having to opt for the modification of mercy killing.
