The purpose of this profesional work is to analyze and develop the main legal problems found in Sentence N°. 855/2021 -PA/TC, File No. 00305-2021-PA/TC, followed by the “Banco de Crédito del Perú” or “BCP” for the Constitutional Grievance Appeal against the Resolution of October 27 in 2020 issued by the Second Constitutional Chamber of the Superior Court of Lima that declared inadmisible the demand for arbitration protection against Willy Quintanilla Legua, for this performance as Sole Arbitrator in the arbitration process 1-2015 followed by María Jesús Villamar Zanabria vs. “Hipermecados Tottus S.A”. The claim for protection presented by “BCP”, has among its main claims the annulment of the arbitration resolutions issued by the Arbitrator in the arbitration process, which were intended to extend the arbitration agreement to BCP as “non-signatory- party” to the aforementioned arbitration process; in adition to the imposition of a fine in the event that the latter does not comply with executing the precautionary measure of retention by embargo. For all lof the above, the apellant requested to be excluded from the arbitration process. In this sense, the central analysis of the ruling will focus on determining the relevance of the extension of the arbitration agreement based on the definition of the non-signatory party and the intervention of third parties in the execution of precautionary measures provided in the arbitration process.
