In the present case, the spouses Zósimo Gervacio Basilio de Paz and Cresencia Alicia Mata Valverde filed a cassation suit for the declaration of better property rights against Abraham Requena Santiváñez and Hilvia Carmen Oroya Chávez before the Supreme Court of Justice of the Republic. This paper will analyze whether it is possible to promote a process of better right of ownership against a person who has a final judgment of acquisitive prescription on a property, based on the lack of incorporation to this process and of having had a registry title of the property in dispute. In view of the above, an important issue for judicial practice will be elucidated, as to whether a manifest violation of fundamental rights such as the right to defense and due process can be remedied through the process of better right of ownership, since the plaintiffs had standing to intervene in the prescription process; on the contrary, they were neither summoned nor incorporated into the process. Likewise, we conclude that a process of prescription on a registered property, in which the registrant was not included as a defendant, suffers from a defect that affects fundamental rights. However, it is evident that the way to remedy this situation is not the process of better right of ownership, where it is limited to compare two titles of ownership, being the correct way to file an action of amparo. Finally, we point out that the sources to elaborate the work were magazines, digital books, thesis, jurisprudence and legislation applicable to the matter.
