In this work we will analyze Cassation No. 3039-2018 Ancash, in matters of Labor Law, which has as a controversy the realization of the Animus Nocendi by the employee, which materializes in the delivery of false information, against the employer. In this way, to avoid the interpretation of this intention to do harm as being subjective, it was proposed that the legislators add a subsection in article 25 of the Productivity and Competitiveness Law classifying as a serious offense the failure to strictly carry out the reason for the application for a work license. In support of the proposal, an investigation of doctrine and jurisprudence was carried out that addressed the labor issues in controversy. In this way, the proposal and the research carried out seek to reduce the criteria of interpretation of the judges regarding the Animus Nocendi as it is expressed subjectively. Thus, it can be seen that currently there are no adequate parameters to evaluate the criterion of the employee's intention to cause harm.
