Due process is an essential right that analyzes the regulatory requirements established by our legal system to ensure the unrestricted respect of the parties involved in a prompt and expeditious justice. Thus, in accordance with the provisions of Article 139, paragraph 3, of the Political Constitution of Peru, the Constitutional Court has established in repeated pronouncements that the right to due process must be guaranteed in any kind of procedure, including judicial and arbitration processes. This right encompasses, as part of its essential content, ensuring the parties involved receive a reasoned, motivated, and consistent response, as this guarantees that justice is administered in accordance with the Political Constitution of Peru and the laws that govern us. Hence, the need to demand properly motivated decisions is not only a requirement in the judicial realm but also in arbitration. Therefore, both judges and arbitrators must ensure that their pronouncements are adequately motivated. This serves as a limit to the exercise of judicial control since it defines or delimits the pronouncement to be issued, which must adhere to the claims made. In this paper, we will analyze the issues mentioned in the context of the pronouncement issued by the First Specialized Civil Chamber in commercial matters of the Superior Court of Justice regarding the Arbitral Award dated January 16, 2015, as well as the resolution by the Supreme Court.
