This case consists of a divorce proceeding based on the grounds for de facto separation, in accordance with numeral 12 of article 333 of the Civil Code. Whereby, Mr. M.F.A. (hereinafter, “the Plaintiff”) filed a divorce petition on October 3, 2008, against Mrs. D.R.C. (hereinafter, “the defendant”) and the Public Ministry, alleging that for more than 7 years he has been separated from his spouse, given that Mrs. D.R.C. decided to retire from the home where they resided together with their minor child, therefore, they requested as their main claim that the marriage bond be dissolved and as ancillary claims that it be established that parental authority is in charge of both parents, that the regime be maintained of visits and grant compensation in his favor for damage to the person referred to in article 345°-A of the Civil Code, for an amount of S/ 20,000.00. On the other hand, the defendant answered the lawsuit alleging that she was forced to withdraw from the matrimonial home due to the constant physical and psychological attacks that she and her under-age son received from the plaintiff, likewise, she requested that they grant her an amount of compensation to S/ 100,000.00, due to the various lawsuits he faced for years and for the damages suffered. In this sense, it is appropriate to verify if the elements have been fulfilled so that the grounds for divorce requested by the plaintiff are configured. Likewise, it corresponds to determine who has the status of spouse most affected, therefore, the criteria set by the Third Plenary Civil Cassatory will be analyzed.
