This research paper aims to draw attention to a specific theoretical aspect of arbitration as an alternative dispute resolution mechanism: the possibility that arbitrators can perform diffuse control. To this end, it is essential to address issues such as the legal nature of arbitration and its compatibility with the idea of jurisdiction that, for example, is recognized to the Judiciary. From this, it will be possible to establish the appropriate role and limits of the arbitration function in terms of regulatory control in our legal system. This is intended to contribute to the proper development of the Constitutional Rule of Law in our country and to strengthen the fundamental principles contained in the Constitution. In this sense, it is also analyzed whether the jurisprudential development on the matter has been rigorous in its considerations on the democratic constitutional principles and the fundamental rights of citizens, which is essential to maintain a social order, in which people and institutions comply and respect the provisions of our Constitution and the laws, without the problem that these contradict each other.
