The public file substantiation matter deals with a dismissal annulment process filed by a worker who claims to have been fired by his employer as a retaliatory measure for having filed a claim against him before at the Administrative Labor Authority, since he had been being coerced to sign contracts subject to a modality on a monthly basis despite the fact that his work carried out within the company was of a permanent nature and inherent to the line of the business. The employer reports that the employee has not been fired, but rather having incurred a serious misconduct by leaving the job for more than three days, he was urged to remain in the position and comply with the audit for the transfer of position, according to as agreed in the contract. The controversy will focus on determining whether it is appropriate to declare the nullity of the employee's dismissal for having filed a claim against his employer before at the Administrative Labor Authority.
